SaaS Service Agreement

This Agreement allows you ("Merchant") to use the Windoe Loyalty Platform. By accessing our Dashboard, you agree to these terms.

1. Platform Role

We provide the software to manage loyalty cards. You are the "Data Controller" of your customers' data. We act solely as the "Data Processor." You are responsible for securing explicit consent from your customers under the GDPR before entering their data.

2. Acceptable Use

You agree not to use this platform to spam, harass, or collect sensitive data (health, financial, etc.) from customers. We reserve the right to ban any account engaging in such behavior immediately.

3. Liability

We are not liable for any lost profits or data. The service is provided "as is." You agree to indemnify us against any legal claims arising from your use of customer data or violations of the General Data Protection Regulation (GDPR).

4. Fees & Payments

Services are billed on a subscription basis. Payments are non-refundable unless otherwise required by law. Failure to pay may result in immediate suspension of services.

5. Governing Law

This agreement is governed by the laws of Spain and the European Union, depending on your billing address.

Privacy Policy (End Users)

This section applies to customers joining a loyalty program powered by Windoe.

1. Data We Collect

We collect your Name, Email, and/or Phone Number solely for the purpose of issuing your digital loyalty pass and tracking your rewards.

2. How We Use It

Your data is shared only with the specific merchant you joined. We do not sell your data to third parties.

3. Your Rights (GDPR)

Under the General Data Protection Regulation (GDPR), you have the right to request access to, rectification of, or deletion (right to be forgotten) of your data at any time. Contact the Merchant directly or email us at support@windoe.shop to exercise these rights.
